How to report content on a Tokolane storefront that infringes your rights, and how a merchant can respond.

Action required before launch. Tokolane has not yet registered a designated agent with the US Copyright Office. Until it does, the safe harbour this process is designed to secure does not apply. Register at dmca.copyright.gov and replace the agent details below.

Designated agent

Copyright notices must go to our designated agent — not to support, which cannot act on them:

Copyright Agent, Gurukul Minds LLC

copyright@tokolane.com

Filing a notice

A complete notice must include all of the following:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you say has been infringed.
  • The URL of the infringing material, precise enough for us to find it.
  • Your name, address, telephone number and email address.
  • A statement that you believe in good faith that the use is not authorised by the owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act on their behalf.

An incomplete notice may not be actionable. Misrepresenting that material is infringing can make you liable for damages, including costs and legal fees.

What we do with it

  • We remove or disable access to the material identified.
  • We tell the merchant what was removed and why, and pass on your notice.
  • We record the notice against the merchant's account.

Counter-notification

A merchant who believes their content was removed by mistake or misidentification may send a counter-notice to the same agent, giving their signature, the material and its former location, a statement under penalty of perjury that its removal was a mistake, their contact details, and consent to the jurisdiction of the appropriate court.

We forward it to the complainant. If they do not tell us within ten business days that they have filed a court action, we may restore the material.

Repeat infringers

We terminate the accounts of merchants who repeatedly infringe. [Counsel: define the threshold — a stated, consistently applied policy is a condition of safe harbour, not a nicety.]

Trade marks and other rights

Trade mark complaints, counterfeit reports and other intellectual property claims also go to copyright@tokolane.com. Selling counterfeit goods breaches our Acceptable Use Policy and is grounds for immediate suspension.
